General Terms of Use

Version 2.2 · Effective 11.10.2026Last updated: 11.10.2026

1. Purpose and scope

1.1 Purpose

These General Terms of Use (the “Terms”) govern access to and use of the institutional website of Association Logout Neuchâtel (the “Association”), in particular viewing its content, using the contact and information request forms, and accessing information about the Association’s activities, events and programmes.

1.2 Scope

The Terms apply to any person who accesses or uses the Site (the “User”).

Certain services, in particular event registrations, memberships, workshops, training courses or digital services, may be subject to specific conditions, a registration form, a separate contract or specific rules communicated at the time of registration or order.

In the event of a conflict between these Terms and specific conditions expressly applicable to a particular service, the specific conditions prevail for that service, to the extent of the conflict.

These Terms do not replace the Association’s statutes, its privacy policy, or any contractual conditions specific to a service.

1.3 Acceptance

Users are invited to read these Terms before using the Site.

Use of the Site implies compliance with the provisions applicable to such use. Where a service requires express acceptance of specific conditions, that acceptance must be obtained in the manner provided for that purpose.

2. Identification and status of the Association

2.1 Identification

The Site is operated by:

2.2 Legal status

Association Logout Neuchâtel is an association under Swiss law, established in accordance with Articles 60 et seq. of the Swiss Civil Code, subject to its statutes and its actual legal status.

2.3 Purpose and activities

The Association carries out prevention, education, awareness-raising and wellbeing-promotion activities addressing the risks associated with digital transformation, in particular in relation to digital health, behaviour, cognition, social relationships, human-centred cybersecurity and the use of artificial intelligence.

In this context, it may in particular organise workshops, conferences, events, educational programmes, group activities, training courses and prevention initiatives, as well as develop or offer digital resources and tools.

The activities actually offered are presented on the Site or in the documents specific to the services concerned.

This summary does not replace the Association’s statutory purpose; in the event of any discrepancy, the statutes prevail.

3. Services and content offered

3.1 Nature of the services

The purpose of the Site is in particular to present the Association, its objectives, activities, projects and events, and the ways to take part or provide support.

Depending on the features available, Users may in particular:

  • view information published by the Association;
  • request information using the forms provided for that purpose;
  • express interest in an activity or programme;
  • submit a membership application;
  • register for an event or activity;
  • book a digital well-being coaching session;
  • access educational resources or platforms linked to the Association’s projects;
  • make a payment where this feature is offered.

The availability of these features depends on the services actually enabled on the Site.

3.2 General information

Information published on the Site is provided for information, prevention and educational purposes. On its own, it does not constitute a binding contractual offer, unless expressly stated otherwise.

Descriptions, dates, times, prices, participation arrangements and service features may be specified in registration documents or in communications specific to each activity.

The Association endeavours to publish accurate and up-to-date information, without guaranteeing the absence of any error, omission or delayed update.

3.3 Digital services and associated platforms

Some of the Association’s projects may be accessible through separate websites, applications or platforms, in particular Logout Drive.

These services may be subject to specific terms of use, communicated when they are accessed or when registering. These Terms govern such services only to the extent that their scope expressly provides for it.

3.4 Availability

The Association may change, temporarily suspend or withdraw a feature of the Site where reasonably necessary, in particular for technical, security, maintenance, legal compliance or organisational reasons.

To the extent reasonable, the Association endeavours to limit interruptions and to restore the features concerned within an appropriate time. It does not, however, guarantee continuous and uninterrupted access to the Site.

4. Preventive and educational nature of the activities

4.1 Information and prevention

Unless expressly stated otherwise in a contract or specific document, the information, resources and activities presented on the Site are intended for information, education, prevention and skills development.

They do not constitute a medical or psychological diagnosis and do not replace an assessment, follow-up or treatment provided by a duly authorised health professional.

4.2 Limits of information and tools

Any educational content, exercises, simulations, educational assessments and recommendations offered by the Association have a preventive or educational purpose. They must not be interpreted as a clinical assessment or as a guarantee of any individual outcome.

Users remain responsible for assessing their own situation and for the decisions they take on the basis of the information consulted, subject to the legal obligations applicable to the Association.

4.3 Situations requiring specialised care

The Association’s activities are not intended to replace medical, psychiatric, psychotherapeutic or emergency services.

Where a situation requires specialised assessment or care, it is the responsibility of the person concerned to contact a competent professional or service. In the event of immediate danger, they must contact the appropriate emergency services.

This clause describes the general scope of the Association’s activities and must not be interpreted as excluding the legal obligations actually incumbent upon it.

Individual and family coaching sessions are governed by the Digital Well-being Coaching and Educational Support Agreement, which sets out their non-clinical scope and limits.

5. Membership, events and financial conditions

5.1 Membership applications

Membership applications are processed in accordance with the Association’s statutes and the Membership Terms.

Submitting an application does not automatically confer membership. Membership takes effect in accordance with the statutes and, where applicable, following a decision by the competent body.

Members’ rights, obligations, fees and resignation arrangements are governed by the statutes and the Membership Terms.

5.2 Registrations and bookings

Registrations for events, workshops, training courses or other activities are subject to the arrangements communicated at the time of registration.

Where places are limited, a registration only guarantees a place under the conditions specified by the Association. The Association may provide for registration confirmation, a waiting list or other organisational arrangements.

Users are responsible for the accuracy of the information they provide when registering.

5.3 Prices and payments

The applicable prices are those indicated at the time of order, registration or membership, or those agreed in writing between the parties.

Unless stated otherwise, amounts are expressed in Swiss francs (CHF).

Where online payment is offered, it may be processed by a third-party payment provider, in particular Stripe. Payment transactions are also subject to the applicable terms of the provider concerned.

The Association does not ask Users to send their full payment card details by email or through a form not intended for that purpose.

5.4 Cancellation, changes and refunds

The cancellation, change and refund conditions are those communicated for the activity or service concerned, subject to the applicable mandatory provisions.

Where these conditions provide for a cancellation deadline or fees, they must be brought to the User’s attention before the contract is concluded or the registration is finalised.

If an activity is cancelled by the Association, the refund or replacement arrangements are communicated to registered participants in accordance with the applicable conditions and mandatory law.

No provision of this article deprives Users of any right they enjoy under a mandatory rule.

6. Intellectual property and third-party content

6.1 Rights in the content

Unless stated otherwise, the texts, graphics, logos, illustrations, photographs, videos, documents, educational materials, design elements and other content published on the Site are protected by the applicable intellectual property rules.

These rights belong to the Association or to their respective holders.

Access to the Site does not entail any transfer of intellectual property rights to the User.

6.2 Permitted use

Subject to third-party rights and applicable licence notices, Users may view the content and use it for personal, non-commercial purposes.

Any substantial reproduction, modification, public distribution, publication on another website, commercial use or creation of a derivative product requires the prior authorisation of the rights holder, except where an exception is provided for by applicable law.

Uses permitted by law, in particular certain uses for private purposes or quotation, remain reserved.

6.3 Trademarks and distinctive signs

The names, logos and distinctive signs of the Association and its projects may not be used in a way likely to create confusion about the origin of content, an affiliation, a partnership or an endorsement by the Association, without prior authorisation where such authorisation is required.

6.4 Third-party content and services

The Site may embed or refer to third-party content or services, in particular videos, posts or content from social media platforms.

Such content remains subject to the rights and terms of its respective holders. The Association does not guarantee its permanent availability or the accuracy of all the information it contains.

7. User obligations and security

7.1 Lawful use

Users undertake to use the Site in accordance with applicable law, these Terms and the rights of third parties.

In particular, Users shall refrain from:

  • attempting to gain unauthorised access to systems, accounts or data;
  • disrupting the operation or security of the Site;
  • introducing malicious software or carrying out operations intended to compromise the integrity of systems;
  • using the forms for fraudulent, unlawful or abusive purposes;
  • transmitting content that unlawfully infringes the rights, personality or reputation of third parties;
  • circumventing security measures or legitimate access restrictions.

7.2 Accuracy of information provided

When Users provide information to the Association, they undertake to provide accurate information to the extent necessary to process their request or to perform the service concerned.

Users are invited to provide only relevant information and to avoid including in general forms any sensitive or confidential data that is not necessary for their request.

7.3 Security measures

Where there is a reasonable risk to the security, integrity or operation of the Site, the Association may take proportionate measures, in particular temporarily restricting a feature, blocking manifestly abusive access or investigating a technical incident.

These measures are implemented in compliance with applicable law and do not limit the mandatory rights of the persons concerned.

8. External links and third-party services

The Site may contain links to websites, platforms or resources operated by third parties.

These links are provided for information or functional purposes. They do not necessarily mean that the Association endorses all the content, products, services or practices of the operators concerned.

The Association does not control third-party websites and is not responsible for their content, availability or privacy policies, subject to the legal obligations applicable to it.

Before using a third-party service or providing it with personal data, Users are invited to consult the terms and data protection information published by the operator concerned.

Where external content is embedded directly in the Site, its loading and any related data processing are governed by the arrangements described in the privacy policy and, where applicable, in the applicable consent settings.

9. Changes to the Terms

The Association may amend these Terms to take account, in particular, of changes in its activities, the features of the Site, its organisational arrangements or the applicable legal framework.

The version in force is the one published on the Site, together with its date of update.

Changes take effect on the date indicated in the published version. Where a change requires specific notice or acceptance under applicable law or an existing contract, the corresponding measures are implemented.

Changes to the Terms do not retroactively affect rights already acquired or applicable mandatory provisions.

Users who continue to use the Site are responsible for periodically consulting the version in force.

10. Applicable law and dispute resolution

10.1 Applicable law

These Terms are governed by Swiss law, subject to any mandatory rules that may apply to the User’s situation.

10.2 Amicable settlement

In the event of any difficulty relating to the use of the Site or the interpretation of these Terms, the parties are invited to seek an amicable solution.

Any request may be sent to the Association using the contact details given in Article 2.1.

10.3 Place of jurisdiction

Subject to mandatory rules on territorial or subject-matter jurisdiction, the competent courts are determined in accordance with applicable Swiss law.

No provision of these Terms is intended to deprive a consumer or other protected person of a mandatory place of jurisdiction to which they are entitled by law.

10.4 Severability

If any provision of these Terms is declared void, unlawful or unenforceable, in whole or in part, the remaining provisions remain applicable to the extent permitted by law.

The provision concerned shall, to the extent legally permissible, be interpreted in accordance with applicable law. This article shall not have the effect of validating a clause contrary to a mandatory rule.
